TITLE: Appeal of Dismissal
PURPOSE: To establish policy for a student’s appeal
of dismissal from the John D. Bower School of Population Health.
POLICY: A student has the right to appeal a
dismissal from the Bower School of Population Health.
The appeal of dismissal
must be made in writing to the dean of the Bower School of Population Health within
ten (10) working days of the date of the notification of dismissal decision. Failure to make a written appeal within the
ten (10) working day time period shall constitute a waiver of the appeal right
and result in the sanction becoming final as recommended. The written request
for an appeal must set forth the substantive basis for the appeal and be
documented in an official letter to the dean. The official letter of appeal
should be sent as an email attachment to the dean.
The Bower
School of Population Health Academic Council shall act as the appeal committee to
hear all matters concerning dismissal. The student will be informed of the time
and place of the appeal hearing. If the student is enrolled in a traditional
program, the student must appear in person at the hearing to present the appeal
to the appeals committee. If a student is enrolled in a distance education
program, the student must appear in person or be granted permission to appear virtually
(using both audio and video connections) at the hearing to present the appeal
to the appeals committee. The request for permission to appear virtually must
be included in the official letter of appeal to the dean.
During an
appeal hearing, the student shall be permitted, at their own expense, to have
an advisor/legal counsel at the hearing and through all other stages of the
disciplinary process. The role of the advisor/legal counsel shall be limited to
an advisory capacity only. They will not be permitted to make opening or
closing statements, question witnesses, or make oral arguments. The student is
entitled to present witnesses or other evidence, and make opening and
concluding statements on their behalf. If the student elects to bring an
advisor/legal counsel to the hearing, they must give notice to the dean within
two (2) working days prior to the appeal hearing. If a request for permission
to appear virtually is granted, instructions for the virtual process will be
provided.
The Academic Council
deliberates and reviews the case and will forward its written recommendation to
the dean. The dean of the Bower School
of Population Health may accept, reject or modify the recommendation of the
Academic Council. The decision by the
dean of the Bower School of Population Health will be final. The dean will notify the student of the
decision through the student’s official UMMC email account.
The student
shall have the right to file a “procedural” appeal at the institutional level
by writing to the Office of the Associate Vice Chancellor for Academic Affairs
within ten (10) working days of the date of notification of the school’s decision.
To file a procedural appeal to the Office of the Associate Vice Chancellor for
Academic Affairs the student is required to follow all guidelines detailed in
the University of Mississippi Medical Center’s Student Procedural Appeal for Academic Decisions policy.
